TERMS AND CONDITIONS
The agreement between you and GiftDrop.
These terms apply when you use the GiftDrop website or the GiftDrop iPhone app to donate the remaining balance of a gift card. Please read them before you donate. If you do not accept them, do not use GiftDrop.
Who you are dealing with
GiftDrop is a registered business name of Global Outsource Solutions Pty Ltd, ABN 76 147 725 040, an Australian private company registered for GST. In these terms “GiftDrop”, “we” and “us” mean that company.
GiftDrop is a commercial business. It is not a charity, and it is not a deductible gift recipient. We collect donations on behalf of registered Australian charities and retain a disclosed service fee. Contact us at our contact page.
What GiftDrop does
Gift cards are frequently left with a small unspent balance. GiftDrop lets you give that balance to a registered Australian charity you choose, instead of leaving it to expire. You tell us the amount, you choose the charity, and you authorise a card payment for that amount.
We do not check your card’s balance for you on this website. You read the balance from the card issuer’s own page, or in the GiftDrop app, and enter the amount yourself. If you enter more than the card holds, the payment will simply be declined by your issuer.
Our fee, and what the charity receives
We retain a service fee out of each donation. The fee is set per charity as a term of our agreement with that charity, and it is disclosed to you before you confirm — in cents and as a rate, on the same screen as the amount — together with the exact figure the charity will receive.
The fee is rounded down to the nearest cent, so any rounding difference goes to the charity rather than to us. The amount you pay is always the charity’s share plus our fee, exactly.
The split is recorded against your donation at the moment you authorise it. If we later change a charity’s fee, your donation keeps the split you were shown.
Which charities
Every charity you can choose is a registered Australian charity. We verify a charity’s registration, and its deductible gift recipient status where it has one, before it appears in the list. We may add, suspend or remove a charity at any time; suspending one does not affect a donation already authorised to it.
Tax
Whether your donation is tax deductible depends on the charity, not on us. Where a charity is endorsed as a deductible gift recipient and has authorised us to receipt on its behalf, we say so before you confirm and the record we issue says so too. Where it is not, we say that instead.
We do not give tax advice. The record we issue states what was paid, what the charity received and what we retained. Whether and how much you can claim depends on your own circumstances, and is a question for you or your tax agent.
Your payment
Payments are processed by Stripe. Card details are entered into Stripe’s own hosted fields and are never received or stored by GiftDrop. We keep the transaction reference, the card brand and the last four digits — never the full card number, and never the security code.
A donation is authorised when you confirm it and Stripe accepts the payment. Occasionally Stripe takes a little longer to settle; if that happens we tell you the donation is still processing rather than guessing, and it appears in your donation history when Stripe confirms it.
Refunds, disputes and chargebacks
A donation is a gift and is ordinarily final once authorised. The circumstances in which we will refund one, how to ask, and how a dispute is handled are set out in full in our refund and dispute policy, which forms part of these terms.
Your account
Donating requires an account, which you create by signing in with Google, Apple or Microsoft. You are responsible for keeping access to that provider account secure. We may restrict or close an account where we reasonably suspect fraud, card misuse, or a breach of these terms.
You can delete your account at any time — in the app under Settings, or by writing to us. Deletion is immediate and cannot be undone. What is removed and what we must keep is described in the privacy notice.
Using GiftDrop properly
You agree that you will not use GiftDrop to:
- donate using a card you are not entitled to use, or funds that are not yours to give;
- test, probe or validate card numbers, whether your own or anyone else’s;
- launder money, or disguise the source or destination of funds;
- interfere with the service, or attempt to reach parts of it you have not been given access to.
You must be at least 18 years old to donate. GiftDrop is offered in Australia and accepts Australian dollars only.
Availability
We do our best to keep GiftDrop working, but we do not promise it will be available without interruption. We may change, suspend or withdraw any part of it, including the list of charities and the service fee, at any time. Changes to the fee never apply to a donation already authorised.
Liability
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Where our liability can be limited, it is limited to resupplying the service or paying the cost of having it resupplied.
To the extent the law allows, we are not liable for indirect or consequential loss, for loss arising from a card issuer’s or a charity’s own acts, or for a tax outcome different from the one you expected.
Changes to these terms
We may update these terms. The version in force when you authorise a donation is the one that applies to it. Material changes are described on this page with a new date below.
Governing law
These terms are governed by the law of Victoria, Australia, and you and we submit to the non-exclusive jurisdiction of its courts.
